Functions, tasks, powers and organizational structure of the Department of Agriculture and Rural Development of Binh Phuoc province

 

Chapter I

POSITION, FUNCTIONS

Article 1. Position
1. The Department of Agriculture and Rural Development of Binh Phuoc province (hereinafter referred to as the Department) is a specialized agency under the Provincial People's Committee, under the direction and management of the Provincial People's Committee, and at the same time under the direction, guidance, inspection and examination of the expertise and profession of the Ministry of Agriculture and Rural Development.
2. The Department has legal status, its own seal and account, is budgeted for operations and is allowed to open an account at the State Treasury according to regulations.
Article 2. Functions
The Department performs the function of advising and assisting the Provincial People's Committee in state management of: Agriculture; forestry; fisheries; irrigation; rural development; natural disaster prevention and control; quality and food safety of agricultural, forestry, fishery and salt products; public services in the field of agriculture and rural development according to the provisions of law.

 

Chapter II

DUTIES AND POWERS


Article 3. Duties and powers
1. Submit to the Provincial People's Committee:
a) Draft decisions of the Provincial People's Committee related to the fields under the management of the Department and other documents assigned by the Provincial People's Committee;
b) Draft plans, programs, projects, proposals, measures to organize the implementation of tasks on agriculture and rural development under the management of the Department in the province;
c) Draft decisions on decentralization and delegation of state management tasks in the field of agriculture and rural development to the Department and the People's Committees at the district level according to regulations;
d) Draft decisions on the establishment, reorganization, and dissolution of the Department's Sub-Departments; Draft decisions on the organizational structure and staffing of the Department's Sub-Departments;
d) Draft decisions on the establishment, reorganization and dissolution of public service units under the Department in accordance with the provisions of law; Draft decisions on the functions, tasks, powers and organizational structure of public service units under the Department;
e) Draft decisions on the socialization of public service provision activities in the field of agriculture and rural development under the authority of the Provincial People's Committee and under the decentralization of higher-level state agencies.
2. Submit to the Chairman of the Provincial People's Committee:
a) Draft documents under the authority of the Chairman of the Provincial People's Committee to issue as assigned;
b) Draft regulations on management, coordination of work and reporting regime of provincial agricultural and rural development organizations located at the district level with the District People's Committee; professional and technical staff of the agricultural and rural development sector working at the commune level with the Commune People's Committee.
3. Organize the implementation of legal documents, strategies, planning, plans, programs, projects, national standards, national technical regulations, economic and technical norms in the field of agriculture and rural development decided and approved by competent authorities; disseminate information, guide, inspect and monitor the implementation of laws in the fields under assigned state management.
4. Regarding cultivation and plant protection:
a) Advise and submit to the Provincial People's Committee to promulgate under its authority or submit to competent authorities: plans to convert crop structure suitable to the locality, crop structure on rice-growing land in the province; local crop development plans; policies to support production, trade and use of plant varieties, fertilizers, pesticides; plans to prevent and control harmful organisms and quarantine domestic plants;
b) Assist the Provincial People's Committee in directing the implementation of seed structure, season, cultivation techniques, harvesting, preservation, and processing of agricultural products; building and organizing the implementation of areas free of harmful organisms in the area; organizing disease prevention and control, implementing measures to protect production when plant pests occur; making statistics and assessing damage caused by diseases; implementing policies to support stabilizing life and restoring production; organizing the collection of used pesticide packages; building a database on crop production activities in the province and updating the national database system on crop production; building a database on plant protection and quarantine; c) Guiding and inspecting the implementation of crop production activities; developing crop production areas, producing safe agricultural products and food in the province; organizing the implementation of plans to use, protect and improve the fertility of agricultural land, prevent erosion, desertification and landslides; Issue cropping area codes in the province in accordance with the law;

d) Guide and organize the implementation of domestic plant quarantine in the province in accordance with the law;

dd) Organize the collection, storage, conservation and exploitation of plant genetic resources; manage plant varieties, fertilizers, pesticides and other materials serving agricultural production in accordance with the law;

e) Manage and use local reserves of plant varieties, pesticides and other materials for daily use
